The growing cultural diversity of European societies and its strains are at the heart of important contemporary debates. In the legal field, these debates are crystallized around the concept of protection of ethnic, religious or linguistic. This book offers an analysis of the contribution the European Convention on Human Rights to the protection of minorities. The Convention contains no specific provision on the rights of persons belonging to minorities. The book shows, however, through a critical examination of the jurisprudence of the European Court of Human Rights, individual rights, how classic, guaranteed by the Convention can ensure respect and protection of minority identities. It is also necessary that these rights are interpreted dynamically, in light of the principles on which the Convention is based, namely the concepts of liberty, equality and democratic society. The delicate question of the limits of respect due to the cultural is also discussed. To clarify the theoretical problems raised by the jurisprudence of the Court, the analysis takes into account the debates in political philosophy on the theme of multiculturalism and reconciliation of differences in a democratic society.
